Establishing Right to Manage (RTM) - Leaseholders gain full control

Alisha Maidment, Solicitor in the Leasehold team acted for a group of leaseholders pursuing a Right to Manage (RTM) claim in respect of their residential block. The claim was commenced just before the leasehold reforms came into effect, with the notice of invitation to participate being served shortly after the reforms took effect.
Alisha guided the leaseholders through the RTM procedure, ensuring compliance with the new statutory framework while also advising on the implications of the reforms. As the notice was served post-reform, the leaseholders benefited from not being liable for the landlord’s legal costs, reducing their financial exposure. The claim itself was relatively straightforward, as the freeholder did not contest the application.
The RTM company was successfully established, giving the leaseholders full management control of their block without the burden of landlord’s costs.
