Artificial intelligence (AI) is becoming part of everyday life for both clients and lawyers. There are many tools out there that offer a variety of AI services. Some are available without charge, and some attract a fee. In amongst these services there are AI-only law firms which attract a fee but are now being marketed as a cheaper alternative to traditional legal advice. While lower fees and fast turnaround times may sound attractive, clients should approach these services with caution. In this article, Yasmin Khan, trainee solicitor, explains why AI-only firms may not have your best interests at heart, particularly in the context of Settlement Agreements.
What is AI?
AI refers to computer systems that can analyse information, identify patterns and generate responses or recommendations. In legal work, AI can process large volumes of material quickly and assist with routine drafting or review.
What is an AI-only firm?
An AI-only law firm delivers legal services primarily through artificial intelligence systems rather than human lawyers.
What is a Settlement Agreement?
A Settlement Agreement is a legally binding document usually used by employers and employees to agree terms in relation to the termination of employment or resolve a workplace dispute. Often in return for compensation, the employee gives up potential claims arising from their employment and/or its termination.
What are the benefits of using an AI-only firm in the context of an Agreement?
The AI-only firms will be attractive at first blush because they may reduce legal costs, review documents quickly and automate routine drafting. Used carefully, AI can support efficiency and make some legal services feel more accessible.
What are the disadvantages of using an AI-only firm in the context of an Agreement?
The difficulty is that Settlement Agreements are rarely just about reviewing a document. They often involve sensitive negotiations with an employer, careful judgment on what is realistic to ask for, and advice tailored to the full facts of your case. An AI-only firm cannot truly replicate the strategic thinking and commercial awareness that a human employment lawyer brings to the matter. Tone matters, timing matters and so does knowing when to push, when to compromise and how to protect your position without inflaming the dispute (and potentially losing the deal on the table). Poorly judged demands can make matters worse and increase the risk of an impasse and in turn litigation, which then can increase costs. If that happens, the apparent saving at the outset may disappear very quickly. AI will not be as in tune with the tone of responses, reading between the lines as necessary and making a judgment call.
There is also the issue of reliability. AI can produce answers that sound convincing but are incomplete, inaccurate or based on a misunderstanding of the context. That is a serious risk where important legal rights, restrictive clauses and settlement value are concerned. Importantly, a Settlement Agreement must also be signed off by an independent human lawyer to be legally binding, so AI-only services can only go so far and cannot remove that central requirement.
Conclusion
AI can be a helpful tool, and many law firms now use it to improve efficiency and support clients. The key word, however, is support. It should assist legal professionals, not replace the tailored advice, judgment and negotiation skills that clients need when dealing with an employer.
