The Telecom team aims to achieve substantial rental growth whilst introducing modern safeguards to protect the land owner in what is a complex and fast changing area of law.

It requires experienced lawyers familiar with both technical details of Telecommunications Law and techniques to counter mobile phone operators attempts to circumvent existing Agreements.


Background
The UK Mobile Phone Mast market has largely been controlled by the five large operators H3G (“trading as 3”), O2, Orange, T-Mobile and Vodafone.  The operators secured their rights to the network of mast sites during the latter part of the 1990’s and early 2000 using commercial Agreements drawn up by their own lawyers often depriving the Landlord of some of its most basic entitlements.  These Agreements are now typically over 10 years old and are significantly out of date often leaving Landlords with rental income substantially below that of rents being agreed currently on new phone mast sites. 

Rental negotiation
Thackray Williams Telecoms team has successfully renegotiated such Agreements achieving rental growth of in some cases in excess of more than 300% and updated statutory compliance affording the Landlord necessary protection against the perceived health risks associated with masts.  Thackray Williams only acts for Landlords not mobile phone operators.  We are aware all rental negotiations need to be settled at the best possible rent and we achieve this by using specialist surveyors from our approved panel.
