What is a trade mark?

A trademark may be seen as a brand.  It is a way that the public recognises the product or service as yours and yours alone.  It also enables the public to distinguish you from other competing businesses producing the same brand.

There is an extraordinary range of trade marks from shampoos to colours to forms of packaging and even personal names.

It is an invaluable resource that advertises brands of the business.  The bigger your brand the more recognisable your trade mark becomes.  For example, COKE.

For the smaller businesses, it protects your branding from others who may want to use your goods and products as a result of the goodwill your goods and products may generate.  It is therefore advisable to register your trade mark.

Before you register the trade mark, searches will have to be carried out.  There are of course some registration restrictions in respect of registering trademarks but if you wish to find out more, please contact hema.ramachandra@thackraywilliams.com.
